Terms of Service

1. Service Description

Auvano provides an enterprise restaurant operations platform that includes phone call management, order processing, kitchen display systems, menu management, staff scheduling, table management, inventory tracking, and customer relationship management ("the Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Account Terms

  • You must be at least 18 years old and have the legal authority to bind your business to these Terms.
  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorised use of your account.
  • One account per restaurant location. Multi-location businesses require an Enterprise plan.

3. Payment & Billing

  • Fees are billed monthly in advance and are non-refundable except as required by law.
  • A setup fee applies to all new accounts as described during onboarding.
  • Prices are listed in GBP and USD. You will be billed in the currency selected during signup.
  • We reserve the right to change pricing with 30 days' written notice.
  • Failed payments will result in service suspension after a 7-day grace period.
  • All fees are exclusive of applicable taxes, which will be added where required.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable regulations.
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure.
  • Transmit any malicious code, viruses, or harmful data through the Service.
  • Use the Service to make automated calls for purposes other than legitimate restaurant operations.
  • Resell, sublicence, or redistribute the Service without written permission.
  • Interfere with or disrupt the integrity or performance of the Service.

5. Intellectual Property

The Service, including all software, design, branding, and documentation, is owned by Auvano and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service during your subscription period.

Your restaurant data remains your property. You grant Auvano a licence to process your data solely for the purpose of providing the Service. We may use anonymised, aggregated data for service improvement.

6. Limitation of Liability

To the maximum extent permitted by law:

  • Auvano's total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
  • Auvano shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • Auvano does not guarantee uninterrupted or error-free service, though we strive for maximum uptime.
  • Auvano is not responsible for losses arising from third-party service outages (phone carriers, payment processors, etc.).

7. Termination

  • You may cancel your subscription at any time. Access continues until the end of the current billing period.
  • We may suspend or terminate your account for violation of these Terms with written notice.
  • Upon termination, you may request an export of your data within 30 days. After 30 days, all data is permanently deleted.
  • Sections relating to intellectual property, limitation of liability, and governing law survive termination.

8. Governing Law

For UK and European customers: These Terms are governed by the laws of England and Wales. Disputes shall be resolved in the courts of England and Wales.

For US customers: These Terms are governed by the laws of the State of North Carolina, United States. Disputes shall be resolved in the state or federal courts located in Mecklenburg County, North Carolina.
